Snapdragon Just Snap Twitter Sweepstakes

1. PROMOTION TIMING: The Snapdragon "Just Snap" Twitter Sweepstakes ("Sweepstakes") begins at 12:00:01 a.m. E.T. on December 26, 2012 and ends at 11:59:59 p.m. E.T. on January 31, 2013.

2. HOW TO ENTER: To enter, a participant must be a @Snapdragon follower, accept @Snapdragon as a follower, and Tweet on Twitter the hashtag #JustSnap. The Tweet on Twitter must include #JustSnap ("Tweet" or "Entry") and @Qualcomm within message. If you do not have a Twitter account, and you would like to create one, visit www.Twitter.com.  Tweets cannot be longer than 140 characters including the hash tag. In the event of a dispute as to any Entry, the authorized account holder of the email address used to set up the Twitter account will be deemed to be the entrant.  Potential winners may be required to show proof of being the authorized account holder of the email address/Twitter account associated with the Entry.  The Tweet may not contain obscene, lewd or inappropriate content, or otherwise violate these Official Rules or the terms and conditions imposed on users of Twitter, as determined in Sponsor's sole discretion. Any Entry or portion thereof that is, in the Sponsor's sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, other intellectual property rights, mark that identifies a brand or other personal or proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entrants may not copy or otherwise plagiarize the Tweet from any source. Sponsor has the sole discretion to determine whether a Tweet qualifies as an Entry. All Entries must be the sole, original work of the Entrants. Modifying, enhancing or altering a third party's pre-existing work does not qualify as an original work. In such an event, the Entry will be disqualified from the Sweepstakes. Entrants and winners acknowledge and agree that all Entries, including Tweets, become the property of the Sponsor, which has the right to edit, adapt, modify, reproduce, promote and otherwise use all Entries and Tweets in any way it sees fit.  Entries may be posted on Sponsor's and non-affiliated websites, in Sponsor's sole discretion.   Any user who, in Sponsor's sole discretion, posts profanity, pornography or other objectionable content on Twitter, or engages in multiple and excessive Tweeting in violation of Twitter's policies and terms and conditions, Twitter may be removed by Sponsor from being a Qualcomm Follower and from participating in the Sweepstakes. Limit one (1) entry per person per Entry Period defined in Section 3 below.

3. RANDOM DRAWINGS:

The entrants selected as the potential winners must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements. Potential winners will be selected in three (3) separate random drawings listed above, from among all eligible entries received during each Entry Period. Entries must be submitted by 11:59:59 p.m. E.T. on the respective end date listed above, to be included in that corresponding drawing.  Entries received during one Entry Period will not be carried forward into subsequent drawings. The computer clock of the Webmaster hosting the Sweepstakes is the official timekeeping device for the Sweepstakes. The drawingswill be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final and binding in all matters relating to the Sweepstakes. Odds of winning depend on the total number of eligible entries received during each Entry Period.  Prize winners will be notified by direct message from @Snapdragon on Twitter and confirmed by email (the "Direct Message").  If a winner cannot be reached by Direct Message within 48 hours of first notification attempt, an alternate winner will be selected.

4. PRIZES: Ten (10) prizes total will be awarded as noted above consisting of a sponsor specified mobile device, such as the Samsung Galaxy S3 mobile phone {ARV US$549.99}, Droid DNA by HTC mobile phone {ARV US$649.99}, or LG Optimus G mobile phone {ARV US$589.99}. The exact make and model of mobile device will be determined by Sponsor in its sole discretion. Prizes do not include or cover any phone service or mobile data charges.

Names of products or manufacturers are used for purposes of prize description only and such use is not intended to suggest or imply the manufacturer's sponsorship, endorsement, or the approval of this Sweepstakes.  All trademarks referenced herein are owned by their respective companies and do not imply or suggest that such companies endorse or support this Sweepstakes.

Prizes are nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor in the event that the prize cannot be awarded for any reason, in which case, Sponsor will award a prize of equal or greater value. Prizes are awarded "as is" with no warranty (except as specifically included) or guarantee, either express or implied by Sponsor. All taxes, fees and surcharges on prize, and any other expenses associated with the prize receipt and use (such as mobile data charges or phone service) that are not expressly included in the prize description are the sole responsibility of winners. One (1) Prize per person/email, subject to a maximum of one prize per address/household. Winners may be required to submit paperwork related to taxes and may be issued a Form 1099 if their prize has a value of $600 or more.

5. ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older, or the age of majority in their state of residence, whichever is older, as of date of entry. Employees of Qualcomm Incorporated ("Sponsor"), the Sponsor's parent, subsidiaries, affiliated companies, dealers, and agents; Don Jagoda Associates, Inc.; Daniel J. Edelman (collectively, "Sponsor Entities") and the immediate family (defined as parents, spouse, children, siblings, grandparents) of employees of Sponsor Entities, and all those with whom such employees are domiciled, are NOT eligible.  Void where prohibited or restricted by law.  Subject to all federal, state and local laws.

6. GENERAL RULES:

• After the potential Prize winners respond to the Direct Message, they will be contacted by email and will be required to execute and return via mail/email, a notarized Affidavit of Eligibility/Release of Liability and Publicity Release form (where legal) and any required tax documentation within fourteen (14) days of notification attempt or prize will be forfeited and an alternate will be selected. Noncompliance within these time periods will result in disqualification and another winner selected in the place of the disqualified person at random from all eligible entries received during the Entry Period.

• By accepting the prize, winners agree that the Sponsor and those acting under the Sponsor's authority, may use winner's name, picture/portrait likeness,  voice and Tweets on Twitter for advertising and promotional purposes without restriction in any media now known or hereafter developed without further consideration, unless prohibited by law. Entrants agree to be bound by these Official Rules and the decisions of the judges. Entrants further agree that any and all disputes or claims connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, and limited to actual out-of-pocket costs not including attorney's fees or any incidental or consequential damages, or any right of review or approval, unless prohibited by law..

• BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT THE SPONSOR, ITS PARENT, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES AND TWITTER, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ALL LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH OR INVASION OF PUBLICITY/PRIVACY RIGHTS, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY.

• Sponsor and Sponsor Entities are not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost,  incomplete, delayed, or misdirected  entries; or other error of any kind whether human, mechanical, or electronic.  CAUTION: Any attempt to deliberately damage any web site, or undermine the legitimate operations of the Sweepstakes, is a violation of the criminal and civil laws.  Should such an attempt be made, the Sponsor reserves the right to seek damages from any such participant to the fullest extent permitted by law and to disqualify such participant from the Sweepstakes.  In the event the Sweepstakes is compromised by virus, bug, unauthorized human intervention, or other causes beyond the control of Sponsor that corrupts or impairs the administration, security, fairness, or proper play of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend or terminate the Sweepstakes and award prizes from all eligible entries/Tweets received prior to cancellation.

7. DISPUTES: Except where prohibited, Sponsor reserves the right to make all decisions in its sole discretion arising out of or relating to the Sweepstakes, and the decisions by Sponsor are final and binding on all matters relating to the Sweepstakes.  Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (c) notwithstanding the foregoing, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States of America and the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of California.

• PRIVACY: Any personal information that you provide in connection with the Sweepstakes shall be used by Sponsor and Sponsor Entities to administer this Sweepstakes, contact entrants, and for the other purposes set forth in the Sponsor's privacy policy located at http://www.qualcomm.com/site/privacy.  By entering this Sweepstakes you agree to and accept that privacy policy.

9.  WINNERS LIST: For the names of the winners, send a self-addressed stamped envelope, postmarked by April 5, 2013 and received by April 12, 2013, to: Winners List, The Snapdragon "Just Snap" Twitter Sweepstakes, P.O. Box 889, Monrovia, CA 91017. Residents of Vermont may omit return postage.
